This practice is as sophisticated as that of many larger firms as evidenced by the Firm’s representation of local, regional and national developers, retailers, lending institutions, home builders, land owners, contractors, and real estate brokerage companies.

The Firm regularly provides real estate services in the following areas:

Acquisitions, Dispositions and Financings

  • Representing buyers and sellers in the acquisition and disposition of real estate
  • Representing borrowers and lenders in real estate-based financings including acquisition, construction and permanent financings

Debt Restructuring

  • Representing lenders and borrowers in restructuring real estate-based financings including recasting and forgiveness of debt and standby agreements

Real Estate Development

  • Acquisition, development, leasing and disposition of retail, office and residential properties
  • Rezoning property and obtaining variances, special use and other permits and approvals in connection with real estate developments
  • Closing transactions involving historic tax credits

Leasing

  • Representing landlords and tenants in reviewing, drafting, and negotiating commercial leases for all types of properties including office, medical office, warehouse, retail, telecommunications, and restaurants
  • Representing lenders and tenants in preparing, reviewing, and negotiating tenant estoppels and subordination and non-disturbance agreements

Entity Formation

  • Forming limited liability companies, limited partnerships, corporations and other entities for real estate acquisition and development

Recent Transactions Handled By The Real Estate Practice Group Include:

  • Leasing transactions for regional telecommunications company
  • Serving as borrower’s Virginia counsel in the acquisition and subsequent debt and ownership restructuring of an 18 million dollar shopping center in Chesterfield County, Virginia
  • Regularly representing a client active in acquiring and financing numerous properties in the City of Richmond for redevelopment involving state and federal historic tax credits
  • Representing an owner in the sale of a mixed use project in Hanover County, Virginia, including the negotiation of loans, leases, out parcel sales, and protective covenants
  • Regularly representing client active in developing several major residential and mixed-use developments in Chesterfield County, Virginia
  • Regularly representing lenders in asset-based financings
